Welcome to DwellX.com. These Terms of Use explain the rules and conditions that apply when you visit, browse, access, or use our website and related services. By using DwellX.com, you agree to comply with these Terms of Use.

These Terms apply to every part of the DwellX platform and any related digital services we operate, regardless of how you access them, including through desktop computers and mobile devices.

References throughout these Terms to “DwellX,” “the Platform,” “the Website,” “we,” “our,” or “us” refer to DwellX.com and the services we provide through the platform, including advertising and property-related listing services.

By accessing or using DwellX.com, you confirm that you accept these Terms of Use and agree to follow the rules and conditions outlined within them.

By accessing or using the Website, you acknowledge that you have read and understood these Terms and any related policies published on the Platform, and that you agree to comply with them while using our services. If you do not accept these Terms or any applicable policies, you should not access or use the Website.

Registered users will be required to confirm their acceptance of these Terms before accessing certain features or services provided through the Platform.

DwellX provides online marketplace, communication and identity verification services only.

Nothing in these Terms creates any partnership, agency, employment or joint venture relationship between DwellX and any user.

DwellX is an online rental marketplace that allows users to:

• advertise residential rental properties
• search for rental accommodation
• communicate with landlords, agents or tenants
• access related rental marketplace services

DwellX is not:

• a landlord
• a letting agent
• an estate agency
• a property manager
• or a party to any tenancy agreement between users

DwellX acts solely as an online intermediary platform and is not involved in tenancy negotiations, rent collection, property management, or contractual arrangements between users.

DwellX reserves the right to introduce fees or paid services in the future. Any applicable fees will be clearly communicated to users before charges apply.

You must be at least 18 years old to use the Platform.

By using DwellX, you confirm that:

• you are legally capable of entering into agreements
• all information you provide is accurate and truthful
• and you will comply with all applicable Irish and European Union laws

If you are advertising a property, you confirm that:

• you own the property
• or you are authorised to advertise it on behalf of the owner or landlord.

Some features of DwellX may require you to create an account.

You are responsible for:

• keeping your account details secure
• ensuring your account information is accurate
• and all activity carried out through your account

You must not:

• impersonate another person
• create misleading accounts
• or provide false information

We may suspend or terminate accounts that:

• breach these Terms
• engage in fraudulent activity
• misuse the Platform
• or violate applicable laws

Identity verification does not guarantee the honesty, reliability, conduct or legitimacy of any user.

To help improve trust and safety on the Platform, DwellX may require users to complete an identity verification process.

Identity verification is carried out by third-party verification providers, including Stripe Identity.

As part of the verification process, users may be asked to submit government-issued identification documents, including passports or other photo ID, directly to the verification provider.

DwellX does not directly process or store passport or identification documents submitted through the verification process.

By completing verification, users confirm that:

• the information provided is accurate
• the identification documents belong to them
• and they are authorised to submit the documents for verification purposes

DwellX may receive limited verification information from the verification provider, including confirmation that a user has successfully completed identity verification.

Users are solely responsible for the content and legality of their listings.

All property listings published on DwellX must:

• relate to genuine rental accommodation
• accurately describe the property
• include truthful pricing and availability information
• comply with Irish housing, rental and advertising laws
• and include legally required information where applicable, including BER information

Listings must not:

• misrepresent the property
• advertise unavailable accommodation
• contain false or misleading information
• duplicate the same property unnecessarily
• or advertise a property the user is not authorised to let

Users are responsible for complying with all Residential Tenancies Board (RTB) obligations and applicable Irish rental laws.

Where required by Irish law, listings must include:

• a valid BER (Building Energy Rating)
• and any other legally required disclosures

DwellX may edit, reject, suspend or remove listings that breach these Terms or appear misleading, unlawful or suspicious.

Users who advertise properties on DwellX, including landlords, letting agents, estate agents, property managers, and agencies, agree that they are solely responsible for the properties and listings they publish on the Platform.

By publishing a listing, property advertisers confirm that:

• they are legally authorised to advertise the property
• the property is genuinely available for rent
• the information provided is accurate and not misleading
• all advertisements comply with applicable Irish and EU law
• any required licences, registrations, permissions, or consents have been obtained
• they will comply with all Residential Tenancies Board (RTB) obligations and applicable housing regulations
• advertised pricing, deposits, fees, and tenancy terms are lawful and transparent

Property advertisers must not:

• publish misleading or fraudulent listings
• discriminate unlawfully against prospective tenants
• request unlawful payments
• advertise unavailable or fictitious properties
• misrepresent ownership, authority, or availability
• use false identity information
• manipulate listing rankings, enquiries, or engagement metrics

Agencies and business users are responsible for:

• the actions of employees, contractors, and representatives using their accounts
• maintaining the security of agency login credentials
• ensuring all listings published through agency accounts comply with these Terms

DwellX reserves the right to:

• request proof of ownership or authority to advertise a property
• request business verification information
• suspend or remove listings pending verification
• remove listings that appear unlawful, misleading, fraudulent, or non-compliant
• restrict access to professional accounts that repeatedly breach these Terms

DwellX does not guarantee:

• tenant suitability
• tenancy outcomes
• property occupancy
• rental income
• or the accuracy of tenant-provided information.

Users must not publish advertisements that discriminate against individuals or groups.

In accordance with Irish equality legislation, listings must not discriminate on grounds including:

• gender
• civil status
• family status
• sexual orientation
• religion
• age
• disability
• race
• Traveller community membership
• or receipt of housing assistance or social welfare support

Examples of prohibited wording may include:

• No HAP
• Professionals only
• Rent allowance not accepted

This list is illustrative only and not exhaustive.

DwellX may remove discriminatory content without notice.

Images and media uploaded to DwellX must accurately represent the advertised property.

Users must not upload images that are misleading, deceptive or materially altered in a way that misrepresents the property.

AI-generated, AI-enhanced or edited images must not be used to create a false impression of the property.

Prospective tenants are encouraged to view properties in person and independently verify listings before entering into tenancy agreements or making payments to another user.

You agree not to:

• use the Platform for unlawful purposes
• impersonate another person
• harass, threaten or abuse other users
• upload offensive, illegal or misleading content
• scrape, copy or misuse Platform content
• interfere with the operation or security of the Platform
• upload viruses, malware or harmful code
• or use automated systems to access the Platform without permission

Users must comply with all applicable laws while using DwellX.

Users enter into tenancy arrangements and transactions with other users entirely at their own risk.

Verification status, listings or user activity do not constitute endorsement, recommendation or approval by DwellX.

DwellX may allow users to communicate with landlords, agents, tenants or prospective tenants.

Users are responsible for their own communications and interactions.

DwellX does not guarantee:

• the identity of users
• the accuracy of listings
• the availability of properties
• or the outcome of any communication between users

DwellX is not responsible for tenancy negotiations, deposits, contracts, viewings or disputes between users.

Users should not send deposits, rent payments or personal financial information to other users without independently verifying the legitimacy of the property and advertiser.

DwellX does not collect or hold rental deposits on behalf of users.

Users must not:

• advertise properties they are not authorised to let
• impersonate landlords, tenants or agents
• request unlawful payments
• use fake or misleading documents
• or use DwellX to carry out fraudulent activity

DwellX may investigate suspicious activity, remove listings, suspend accounts or report suspected fraud to An Garda Síochána, regulators or other relevant authorities.

Users retain ownership of the content they upload to DwellX, including property descriptions, photographs and listing materials.

By uploading content to the Platform, you grant DwellX permission to:

• host the content
• display the content
• store the content
• reproduce the content for Platform purposes
• and promote the content in connection with operating DwellX

You confirm that you have the right to upload and share any content you submit.

All intellectual property rights relating to DwellX, including but not limited to:

• the DwellX name,
• DwellX branding,
• logos,
• website design,
• software,
• databases,
• text,
• graphics,
• platform functionality,
• and all other content made available through the Platform,

are owned by or licensed to DwellX and are protected under Irish, European Union, and international intellectual property laws.

Users may access and use the Platform solely for lawful personal or commercial rental marketplace purposes in accordance with these Terms.

Except where expressly permitted in writing by DwellX, users must not:

• copy,
• reproduce,
• distribute,
• republish,
• scrape,
• download,
• commercially exploit,
• reverse engineer,
• or create derivative works from any part of the Platform or its content.

Users retain ownership of the content they upload to DwellX, including property descriptions, photographs, and other listing materials.

By uploading or publishing content on the Platform, users grant DwellX a non-exclusive, worldwide, royalty-free licence to:

• host,
• store,
• reproduce,
• display,
• distribute,
• modify for formatting purposes,
• and promote such content in connection with operating, marketing, and improving the Platform.

Users confirm that:

• they own or control all rights necessary for uploaded content,
• the content does not infringe third-party intellectual property rights,
• and DwellX’s use of the content will not violate any applicable law.

DwellX reserves the right to remove any content alleged to infringe intellectual property rights and may suspend accounts associated with repeated infringement.

DwellX processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and Irish data protection legislation.

This may include processing:

• account information
• contact details
• listing information
• enquiry messages
• usage and technical data
• and identity verification status information provided by third-party verification providers

DwellX processes personal data for purposes including:

• operating and improving the Platform
• facilitating communication between users
• identity verification and fraud prevention
• maintaining platform security
• complying with legal obligations
• and responding to user enquiries or support requests

Personal data may be processed on the basis of:

• contractual necessity
• legitimate interests
• legal obligations
• and user consent where required by law

DwellX takes reasonable technical and organisational measures to help protect personal data against unauthorised access, misuse, loss or disclosure.

Users may have rights under applicable data protection laws, including the right to:

• access personal data
• request correction of inaccurate information
• request deletion of personal data
• restrict or object to certain processing activities
• request data portability
• and lodge a complaint with the Irish Data Protection Commission

DwellX may use third-party services and providers to operate certain parts of the Platform, including identity verification, hosting and communications services.

Use of third-party services may be subject to the terms and privacy policies of those providers.

DwellX is not responsible for third-party platforms, services or websites.

Features and services available on DwellX may change from time to time without notice.

DwellX aims to keep the Platform available and functioning properly.

However, we do not guarantee that the Platform will always be available, uninterrupted or error-free.

We may update, suspend, restrict or remove parts of the Platform where necessary.

DwellX is not responsible for interruptions, outages or delays caused by technical failures or events outside our reasonable control.

DwellX is provided on an “as is” and “as available” basis.

We do not guarantee:

• the accuracy of listings
• the conduct of users
• property availability
• or uninterrupted access to the Platform

DwellX makes no representations or warranties regarding the accuracy, legality, completeness or reliability of listings or user-generated content.

DwellX does not inspect, verify, or guarantee the condition, safety, legality, ownership, habitability, licensing, or suitability of properties listed on the Platform.

Property descriptions, photographs, media, and listing information are provided by users and may not always accurately reflect the property.

To the fullest extent permitted by law, DwellX is not liable for:

• tenancy disputes
• fraudulent listings
• user behaviour
• financial loss
• or reliance placed on Platform content

Nothing in these Terms excludes liability that cannot legally be excluded under Irish or EU law.

Users access and use the Platform at their own risk.

DwellX does not warrant that listings are accurate, complete, lawful or suitable for any particular purpose.

Users agree to indemnify and hold harmless DwellX, its directors, employees, affiliates and service providers from any claims, damages, liabilities, losses, costs or expenses arising from:

• their use of the Platform
• their listings or uploaded content
• their interactions with other users
• or their breach of these Terms or applicable law.

Users may report listings or content that they believe are unlawful, misleading, fraudulent or in breach of these Terms.

DwellX may review reported content and take action where appropriate.

Information available on DwellX does not constitute legal, financial or professional advice.

DwellX is not obligated to monitor all listings, messages or user activity, but reserves the right to review, remove or restrict content where appropriate.

DwellX may suspend accounts, restrict access or remove listings where:

• these Terms are breached
• false or misleading information is provided
• unlawful or discriminatory content is posted
• suspicious or fraudulent activity is detected
• or removal is required by law or a relevant authority

Where appropriate, DwellX may provide users with reasons for removal, restriction or suspension.

Users may contact support@dwellx.com to appeal certain moderation, suspension, restriction, or removal decisions. DwellX will review appeals where appropriate but reserves the right to make final decisions regarding Platform safety, compliance, and enforcement.

We may update these Terms periodically.

Updated Terms will be published on: DwellX.com

Your continued use of the Platform after updated Terms are published means you accept the revised Terms.

These Terms are governed by the laws of Ireland.

Any disputes relating to these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the Irish courts.
